TalentDoor General Terms and Conditions
These Terms and Conditions (“GTC”) of Incresco GmbH, Kasinostrasse 10, Zürich (trading as “TalentDoor”), which operates the TalentDoor website, govern the legal relationship between (a) TalentDoor, and (b) each User (including Professionals and Young Talents, all as defined below). These GTC apply to the exclusion of all other terms and conditions, except as may be expressly agreed by TalentDoor in writing. By using the Platform, the User accepts these GTC. If the User does not accept these GTC, the User must not use the Platform. These GTC can be accessed at any time at https://www.talent-door.com/terms-and-conditions. TalentDoor reserves the right to change these GTC at any time. Any changes to these GTC must be notified to the Users in an appropriate manner. If a User does not accept the changes, he must not continue to use the Platform. If a User continues to use the Platform after notification of the changes, he or she shall be deemed to have accepted the changes.
“Young Talent” means any person registered on the Platform who wishes to obtain information about potential employers, who is at least 18 years old and who is still studying or has finished their studies less than 3 years before the date of profile creation on TalentDoor.
“List of Professionals” means the list of Professionals on the Website, which is visible to all Professionals, Young Talents and HR representatives.
“Professional” means any employee of a company who has been selected by that company to join the company’s TalentDoor account and who has established a Professional’s Profile on the Platform.
“HR Representative” means any employee designated as such by a company and approved by TalentDoor, who can manage the team of Professionals from the company and (depending on the company’s contract with TalentDoor) can access Young Talents’ Profiles on the Platform and contact Young Talents through the Platform.
“Platform” means the website www.talent-door.com operated by Incresco GmbH, Kasinostrasse 10, 8032 Zürich, email@example.com, +41 44 508 28 23.
“Profile” means the summary information completed by a Professional or Young Talent in his or her profile section of the Platform.
“Company Profile” means the summary information about a company present on the Platform. Unless otherwise specified on the Company Profile page, the information on a Company Profile is provided to TalentDoor by the company itself or is provided by TalentDoor from publicly available sources and TalentDoor assumes no liability for its validity or accuracy.
“User” means any person or legal entity accessing the Platform (including Young Talents, Professionals, HR Representatives and any third party).
2. Services of TalentDoor
The services of TalentDoor are limited to:
- Operation of the Platform;
- Publication of information related to TalentDoor’s activities;
- Publication of Professional Profiles;
- Publication of Young Talent Profiles;
- Provision of administration tools:
- to enable Professionals and Young Talents to arrange discussions over the Platform and to exchange messages through the Platform.
- to allow HR Representatives (subject to appropriate data protection consents):
- to manage the Professionals in their team;
- to access Profiles of Young Talents and to contact Young Talents through the Platform.
Provision of 1) and 2) is dependent on the kind of contract the company has with TalentDoor.
TalentDoor acts exclusively as an intermediary between Professionals and Young Talents. TalentDoor is never a contracting party with either the Professional or the Young Talent.
Users create their own Profiles on the Platform, either as a Professional or as a Young Talent.
Each Professional and Young Talent undertakes not to make false or misleading statements and is fully responsible for what they choose to publish on their Profile. TalentDoor does not accept any liability for information provided by any Professional or Young Talent. TalentDoor may decline to publish or delete such information or part or all of a Profile at any time without having to provide a reason and without any liability.
A Professional’s Profile is included in the Platform’s List of Professionals and is visible to Young Talents, other Professionals and HR Representatives (but not to anyone else except TalentDoor).
A Young Talent’s Profile only becomes visible to Professionals to whom the Young Talent sends a request for a discussion and is not visible to anyone else other than HR Representatives and TalentDoor.
TalentDoor reserves the right to delete multiple Profiles which it reasonably believes are attributable to the same Young Talent or Professional, without giving advance notice.
A Young Talent has access to the List of Professionals and may contact a Professional directly through the Platform to request a discussion. The Professional may freely decide to accept or reject that request. If the Professional accepts it, he or she will from then on be connected to the Young Talent on TalentDoor, and the Professional and the Young Talent will be able to exchange private messages on the Platform through the integrated messaging system.
The Young Talent may at any time send appointment proposals (three to five date and time slots) to a Professional that he or she is connected to. The Professional can accept one of them or make another proposal of three to five date and time slots. The Young Talent can in turn accept one of the slots proposed by the Professional or make a new proposal.
The Professional is free to accept or decline any request for a discussion and the Professional and Young Talent will freely negotiate the terms on which the discussion will take place: date, time, duration and means of connecting (e.g. through the messaging system on TalentDoor, through an online audio or video call, through a phone call, in person, etc.). The Professional is not allowed to charge a fee to the Young Talent for the discussion or the information provided.
All Professionals on TalentDoor undertake to provide their services in a professional and timely manner.
5. Young Talents
Any User aged 18 or above, who is currently studying or has finished his/her studies not more than 3 years before Profile creation, can register as a Young Talent on TalentDoor after acceptance of these GTC and of the TalentDoor data protection policy.
6. HR Representatives
Each company that has a contract with TalentDoor can designate one or more of its employees as HR Representatives on the Platform. Depending on the contract the company has with TalentDoor, the HR Representative(s) are able to:
- Manage the team of Professionals of that company: invite company employees to create Profiles on TalentDoor as Professionals; remove employees as Professionals from the Platform; allow other members of the team to invite and remove members.
- View Profiles of Young Talents and contact Young Talents through the messaging system integrated in the Platform.
The role a User has on the Platform is determined by the membership that the User has. A User can only have one active membership on the Platform at any time.
Membership on TalentDoor is free for Young Talents. A Young Talent can delete his/her account on TalentDoor at any time.
Professionals’ membership on TalentDoor is regulated through the contract that TalentDoor has with their employer.
The HR Representative(s) of a company is/are responsible for inviting employees to join TalentDoor as Professionals and for revoking their Professional membership status if so desired.
The Professional and Young Talent each undertake to keep all topics discussed during their sessions confidential, unless otherwise agreed upon by both the Professional and Young Talent.
9. User Declarations
The User declares that he or she: (a) is 18 years or older and resides in Switzerland; (b) is entitled to enter into a contract; (c) has provided accurate and complete information which is not misleading; (d) will maintain User information up-to-date at all times.
10. Data Protection
TalentDoor undertakes to process personal data of Users, in particular registration data, carefully and in accordance with the Swiss Data Protection Act. TalentDoor processes the data according to the data protection policy of TalentDoor. The data protection policy of TalentDoor is an integral part of these GTC and is available at the following link: https://www.talent-door.com/privacy-policy.
11. Proper use
Users are responsible for the legal and contractual use of the Platform and must always comply with applicable laws, in particular criminal law, the Federal Act on Data Protection including implementing provisions, intangible property rights and any applicable foreign law during use. Each User is responsible for the confidential safeguarding of his or her login data and for all activities that are processed via his or her User account, and will prevent unauthorized third party access. All entries made via a User account are attributable to the respective User. The User is fully liable for misuse of his or her User account. Each User undertakes not to publish any illegal, offensive, discriminatory or pornographic content or content which violates another individual’s personal integrity or the principles of good faith and public order.
No User will cause damage to TalentDoor’s IT systems or those of its providers or third parties including by introduction or dissemination of computer viruses. No User will seek to gain access to another User’s information in an unauthorized manner or to modify or manipulate the content provided by another User.
12. Intellectual property rights
The software developed by TalentDoor as well as the entire content of the Platform including graphical elements, source code, design, browsing structure, databases, images, trademarks and logos (except for User data) is protected by copyright or other applicable intellectual property rights and is the property of either TalentDoor or third parties. It may not be copied, edited, distributed or otherwise modified without the express written consent of TalentDoor or the relevant third party.
13. Limitation of Liability
The following limitations of liability apply to the extent permitted by law.
The Profiles, publications and other content made available on the Platform by Professionals, Young Talents or other Users do not originate from TalentDoor. TalentDoor does not control the content and therefore does not accept any liability for the accuracy, legality, quality or suitability for specific purposes of such content. Content provided by TalentDoor is intended exclusively for general information purposes and TalentDoor does not provide any guarantee regarding its accuracy or completeness.
TalentDoor acts exclusively as an intermediary between Professionals and Young Talents and does not guarantee the competency, effectiveness or success of any services provided by a Professional. TalentDoor does not guarantee a minimum number of discussion requests that a Professional will receive or the nature or quality of such requests.
If the Young Talent is not satisfied with any matter relating to the interaction or communication with the Professional, any claims must be made by the Young Talent directly to the Professional and vice versa, and TalentDoor shall have no liability for such claims.
Although TalentDoor tries to maintain the operation of the Platform 24 hours a day, TalentDoor shall not be liable for the temporary unavailability of the Platform, the failure of any functionality on the Platform, or the non-delivery of requests or other communications.
TalentDoor reserves the right to amend, suspend or terminate all or part of its services at any time. TalentDoor shall inform the User of this promptly.
The transmission of data over the Internet is not completely secure. Although the Platform is SSL-encrypted to protect the transmitted content, TalentDoor cannot guarantee the security of the data. Any transmission of data is therefore at the User’s own risk.
In any case, any liability of TalentDoor is limited to unlawful intent or gross negligence. Liability for indirect or consequential damages (including loss of revenue and loss of data) is excluded.
14. Severability clause
Should any provision of these GTC be or become invalid or void, this shall not affect the remaining provisions of these GTC. Invalid or void provisions shall be replaced by provisions which are valid and come closest to the economic purpose of the invalid or void provision. The same procedure is to be followed if a contractual gap arises or if a provision proves to be impracticable.
The relationship between TalentDoor and any User shall be governed by substantive Swiss law excluding the conflict of law rules. The courts of Zurich, Switzerland, shall have exclusive jurisdiction to judge any dispute.
